1. Terms and Conditions of Sale and Website Use
Last updated: 05/11/26
These Terms govern access to http://www.honeybadger.com (the “Website”) and contracts for goods supplied by glass art scotland ltd., trading as HoneyBadger (“Company”, “we”, “us” or “our”). By placing an order, the customer (“Customer”, “you” or “your”) agrees to these Terms. Nothing in these Terms affects rights that cannot lawfully be excluded or restricted.
1.1 Business information
Glass art scotland ltd. is a company registered in accordance with companies house SC595668, with its trading address at unit 17 130 coursington road, Motherwell ML1 1PW. Contact: honeybadgerscotland@gmail.com, 01698 652683.
1.2 Eligibility and lawful purchasing
You must have legal capacity to enter into the relevant contract. Where a product is subject to an age-of-sale restriction, you must satisfy the applicable legal age requirement and any verification process imposed by us.
1.3 Products and descriptions
We take reasonable care to describe goods accurately. Images are illustrative and colours, finishes, handmade items, print output and manufacturing dimensions may vary within reasonable tolerances. Any material characteristics, compatibility requirements or limitations stated on a product page form part of the product description.
1.4 Orders and contract formation
Submitting an order constitutes an offer to purchase the goods shown at checkout. Receipt of an automated order acknowledgement does not, by itself, mean that we have accepted that offer. Unless we state otherwise during checkout, acceptance occurs when we send confirmation that the order has been accepted for fulfilment or dispatch. We may decline an order before acceptance, including where a product is unavailable, information is materially incorrect, lawful age verification has not been completed, payment has not cleared, or fulfilment would be unlawful.
1.5 Prices and payment
Prices are displayed in pounds sterling and will state whether applicable taxes and delivery charges are included or added at checkout. The available payment methods are those displayed at checkout. Where Direct Bank Transfer is selected, the customer must use the order reference and the order will not be released for fulfilment until cleared funds are confirmed.
1.6 Age and compliance checks
We may use proportionate age, identity, fraud-prevention or compliance checks where reasonably required. An order may remain on hold while a required check is completed.
1.7 Delivery
Delivery options, charges and estimated times are displayed or otherwise communicated before the order is placed. Delivery provisions are set out in the Delivery and Shipping Policy, which forms part of these Terms.
1.8 Cancellation, returns and faulty goods
Consumer cancellation and statutory remedies are set out in the Returns, Refunds and Cancellation Policy. Bespoke or personalised goods may be subject to different cancellation rules where the law permits.
1.9 Intellectual property
The Website and its original content, branding, photographs, graphics, copy and other materials are protected by applicable intellectual-property rights and may not be reproduced for commercial use without permission, except where the material belongs to a third party or the law allows otherwise.
1.10 Misuse of the Website
- Do not use the Website unlawfully or fraudulently.
- Do not attempt unauthorised access to the Website, hosting environment, customer accounts or connected systems.
- Do not knowingly introduce malicious code or interfere with the Website’s normal operation.
- Do not provide materially false information in an order or attempt to circumvent a required age-verification control.
1.11 Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited. If you are a consumer, we do not exclude liability or remedies arising from mandatory consumer law. Any limitation applying to a business customer must be read subject to applicable law and any separately agreed business terms.
1.12 Events outside reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, but this does not remove any mandatory consumer rights. We will take reasonable steps to minimise the effect of such an event and communicate material disruption where appropriate.
1.13 Severability and waiver
If a provision is found unenforceable, the remaining provisions continue so far as legally possible. A delay in exercising a right does not by itself waive that right.
1.14 Third-party rights
Except where these Terms expressly state otherwise, a person who is not a party to the contract has no right to enforce it under the Contracts (Rights of Third Parties) Act 1999.
1.15 Governing law
If you are a consumer resident in the United Kingdom, these Terms are governed by the applicable law of the part of the United Kingdom in which you live and you retain any mandatory rights available to you concerning where proceedings may be brought. Business-to-business contracts are governed by the law of England and Wales and, unless separately agreed, the courts of England and Wales have exclusive jurisdiction.
